BOOKING TERMS & CONDITIONS

By submitting a Booking for a Property, you are accepting these terms and conditions and you are entering into a contract between Yourself and the Owner of the Property subject to these terms and conditions.

AGENT FOR THE OWNER

1.1 Norfolkcottageholiday.com Ltd. arranges short-term holiday rentals of the Properties as agent for the Owner.

CONTRACT

2.1 The Contract for renting the Selected Property is between You and the Owner and is subject to these Booking Conditions.

2.2 By making a Booking you are deemed to have made an offer to enter into a contract with the Owner for the letting of the Selected Property in accordance with the Booking Conditions.

2.3 The Booking will be deemed accepted and the Contract referable to the Booking will come into effect and be legally binding only when Norfolkcottageholiday.com Ltd. sends a formal confirmation email to your designated email address. See also 3.5

2.4 Prior to your formal confirmation email your Booking is provisional and dependent on acceptance by the Owner. Following an online Provisional Booking your payment will be acknowledged but there will be a delay prior to you receiving a formal Booking confirmation.

2.5 Under no circumstances will Norfolkcottageholiday.com be liable for any additional expenses or costs incurred by You in relation to your holiday in the period between provisional Booking and formal confirmation

  1. BOOKING AND PAYMENT

3.1 Provisional Booking is made via the Norfolkcottageholiday.com website. Following an online provisional Booking your payment will be acknowledged but there will be a delay prior to you receiving a formal Booking confirmation.

3.2 If, when making your Booking, the start date of your proposed Rental Period is more than 8 weeks away, You must pay a deposit of one half of the Rental Fee, plus one half of the £20 damage waiver (see 8.9), to Norfolkcottageholiday.com Ltd. The balance of the Rental Fee and the damage waiver is payable no later than 8 weeks before the start of the Rental Period.

3.3 If the Booking is made 8 weeks or less before the start of the Rental Period then the entire Rental Fee, plus a £20 damage waiver (see 8.9), is payable at the same time as your Booking.

3.4 Norfolkcottageholiday.com Ltd. reserves the right to cancel your Booking at any time and retain the deposit if the balance is not received by the due date.

3.5 Norfolkcottageholiday.com Ltd. will issue an email Booking confirmation to you once;

  • you have successfully completed our online Booking form,
  • we have double-checked property availability with the Owner,  
  • all money due at the time of Booking has been received as cleared funds.

You must check the confirmation form carefully and notify Norfolkcottageholiday.com Ltd. immediately in case of any discrepancy or mistake.

3.6 Before Norfolkcottageholiday.com Ltd. issues a confirmation either Norfolkcottageholiday.com Ltd. or the Owner may, at any time, accept Bookings from other customers for the Selected Property.

3.7 If the Selected Property is unavailable for your selected Rental Period and Norfolkcottageholiday.com Ltd. is unable to accept the Booking for this or any other reason, Norfolkcottageholiday.com Ltd. will return all money received from you in full.

3.8 If Norfolkcottageholiday.com Ltd is unable to confirm a provisional Booking we will refund your payment in full. Under no circumstances will Norfolkcottageholiday.com Ltd be liable for any additional expenses or costs incurred by You or by your guests.

  1. METHODS OF PAYMENT

4.1. Deposit payments must be made using the payment system on the Norfolkcottageholiday.com Ltd. website. Subsequent payment must be made either by BACS or by cheque.

4.2 Owners may decide to alter Property Rental Fees at any time. However, once your Booking is confirmed the Rental Fee will not change.

  1. CANCELLATION

5.1 If you cancel the accepted/confirmed Booking for any reason, you must notify Norfolkcottageholiday.com via email using the address stated in these Booking Conditions.

5.2 The cancellation date will be the date that your cancellation email is received by Norfolkcottageholiday.com. Proof of sending an email will not be accepted as proof of receipt. We would aim to respond to cancellation emails as quickly as possible. If your cancellation email is not received by Norfolkcottageholiday.com then no cancellation of your Booking Contract will occur.

5.3 A cancellation charge is payable depending on the number of days before the Rental Period start date that the notice of cancellation is received by Norfolkcottageholiday.com. The amount payable is set out below, where number of days refers to the number of days notice given at cancellation prior to the Rental Period start date, and the Cost refers to the percentage of the rental cost of the Selected Property. In the event of cancellation the relevant percentage of the damage waiver charge (see 8.9) will be refunded in full. 

  • Number of days notice given at cancellation prior to start of Rental Period (1-28): Cost will be 100% of the rental value.
  • Number of days notice given at cancellation prior to start of Rental Period (29-56): Cost will 50% of the rental value.
  • Number of days notice given at cancellation prior to start of Rental Period (greater than 56): Cost will be an administration fee of £30.

5.4 Please note that should a cancellation be made the Owner shall be entitled to retain sums received from you, in accordance with 5.3, and will not be obliged to communicate directly with you in any way.

5.5 If the Selected Property which you have booked and which has been accepted becomes unavailable or unusable for any reason prior to the start of the Rental Period, Norfolkcottageholiday.com will attempt to find a suitable alternative Property from the properties listed on the website Norfolkcottageholiday.com. If an alternative Property is not available Norfolkcottageholiday.com Ltd. will return all money received from you in full.

5.6 If you agree to take an alternative Property, you will be sent a confirmation email setting out details of the new Property, Rental Fee, and Rental Period, and you will be deemed to have entered into a new contract with the Owner of the new Property, as detailed in these Booking Conditions and you shall be liable to make payments in accordance with these Booking Conditions.

5.7 You are advised to consider purchasing holiday cancellation insurance.

  1. RENTAL PERIOD

6.1 The Rental Period commences, unless otherwise notified, at 4.00pm on the date of arrival and terminates at 10.00am on the date of departure.

6.2 If your stay extends beyond the period of hire in condition 6.1, you may be subject to a charge for the additional time based on the application of the daily rate for the Selected Property.

6.2 If your stay extends beyond the period of hire in condition 6.1, you may also be subject to a charge for any additional costs incurred by the Owner or Norfolkcottageholiday.com while the Owner’s or Norfolkcottageholiday.com’s designated housekeeping staff are waiting for the Property to be vacated.

  1. CHANGES OF RENTAL PERIOD

7.1 Norfolkcottageholiday.com will consider a request from you to change the Rental Period or the Selected Property after your Booking has been confirmed and accepted. Such a request will only be considered if the Selected Property is available for the new period requested and you pay any sums due in respect of any higher prices for the Selected Property for the new dates as well as an administration fee of £30.

PROPERTY USE & CARE

8.1 You agree that the number of people staying at the Selected Property will not exceed the maximum number stipulated on the Website or by the Owner.

8.2 You agree that the Selected Property will be used for personal and domestic purposes only.

8.3 You agree that the Selected Property will not be used for any commercial purposes.

8.4 You agree that the Selected Property will not be used for any activity or in such a way as to cause a nuisance or annoyance to neighbours of the Selected Property.

8.5 You agree that you and your guests will comply with any reasonable regulations relating to the Selected Property or the site within which the Selected Property is situated, which will be communicated to you upon/prior to your arrival at the Selected Property.

8.6 Smoking of tobacco in any form or e-cigarettes is not permitted within any property offered by Norfolkcottageholiday.com.

8.7 You agree that the property will remain securely locked when you are out and that you will take every action possible to avoid the risk of fire, theft or flood affecting the property.

8.8 You agree to keep the Selected Property and its contents in the same condition and repair as found on your arrival at the Selected Property and agree that your guests shall also take such care of the Selected Property and its contents.

8.9 For each Property the Owner has agreed a Damage Waiver Charge of £20.00. This means that the costs of making good any accidental loss or damage to the Selected Property and/or its contents by You or any of your guests up to a predetermined amount of £100 will not be recoverable from You. Where the costs of repair of any accidental loss of damage to the Selected Property exceeds £100, you agree to pay Norfolkcottageholiday.com all reasonable costs incurred in making good any such loss or damage upon written demand. The damage waiver charge is not refundable at the end of your holiday. Please note that if the Owner reasonably believes that any loss or damage is non-accidental then Norfolkcottageholiday.com reserve the right to recover the entire cost of the loss or damage upon written demand.

8.10 You shall abide by all instructions with regard to the use of the Selected Property and its fixtures and fittings as notified to You by Norfolkcottageholiday.com or the Owner.

8.11 You must ensure that the Selected Property is left in a clean and tidy condition on your departure at the end of the Rental Period. Norfolkcottageholiday.com may charge you for the reasonable costs of any additional cleaning that is reasonably considered necessary.

8.12 You agree to inform the Owner directly within 24 hours should any accidents or damage occur. If for any reason You cannot contact the Owner we will endeavour to forward information to them on your behalf.

  1. PETS

9.1 Dogs/cats/other domestic pets are not permitted in any of the properties listed on the Norfolkcottageholiday.com website

9.2 Guests with allergies should be aware that the Owner cannot guarantee that there have never been any dogs/cats/other domestic pets at any Selected Property, nor does the Owner accept any liability for any suffering which may occur as a result of such pets having been present.

  1. OWNER ACCESS & RIGHT OF ENTRY

10.1 Norfolkcottageholiday.com and the Owner shall have the right of entry to the Selected Property at all reasonable times. In an urgent or emergency situation immediate access may be required, for the purposes of inspection or to carry out any necessary repairs or maintenance.

  1. REFUSAL OF BOOKINGS AND TERMINATION OF CONTRACT

11.1 Norfolkcottageholiday.com and the Owner reserve the right to refuse Bookings from groups of people under the age of 21 and/or hen or stag parties. You agree to inform Norfolkcottageholiday.com at the time of your Booking if your party consists entirely of people under the age of 21 and/or is a hen or stag party.

11.2 Norfolkcottageholiday.com and the Owner reserve the right to terminate a Contract and ask You and your guests to leave the Selected Property immediately if it is deemed necessary by Norfolkcottageholiday.com or the Owner as a result of either inappropriate and/or threatening behaviour and/or abuse (written, verbal or physical) and/or any other material breach of these Booking Conditions by You or by your guests. In the event of such Contract termination the Owner reserves the right not to refund to you any part of the Rental Fee in respect of the shortened Rental Period.

COMPLAINTS

12.1 Should there be any cause for complaint during your stay in the Selected Property, You agree to provide Norfolkcottageholiday.com with details of any complaint by email as soon as practicable and within 7 days of the end of your holiday period at the very latest. Your comments will be forwarded to the Owner. Norfolkcottageholiday.com will attempt to resolve any complaints on behalf of the Owner but cannot guarantee to do so.

12.2 In the event that You feel that your complaint has not been resolved to your satisfaction by the Owner, you agree to seek the services of a civil mediation provider working in the Norfolk area.

  1. LIABILITY

13.1 Norfolkcottageholiday.com acts as agent on behalf of the Owner and is not liable for any injury, loss or damage to personal property (including motor vehicles) during your Rental Period. Neither is Norfolkcottageholiday.com liable to You or any of your party for any acts or omissions made by the Owner resulting in loss, injury or accident.

13.2 Norfolkcottageholiday.com tries to ensure that Property details are correct but cannot accept any liability for changes beyond our control. Please note that we cannot exclude the possibility that some changes may occur between the time of your Booking and the start of your Rental Period.

13.3 Norfolkcottageholiday.com will not accept liability for events beyond their reasonable control, including but not limited to; plumbing, wiring, electrical system failure, exceptional weather conditions, temporary invasion of pests.

FORCE MAJEURE

14.1 Neither Norfolkcottageholiday.com nor the Owner shall be liable for any delay or non-performance of their obligations under the Contract if said performance is interrupted or prevented by any act beyond its reasonable control.

  1. DATA PROTECTION

15.1 For the purposes of the Data Protection Act 1998, the Owner and Norfolkcottageholiday.com are Joint Data Controllers of all personal data provided to Norfolkcottageholiday.com by You. The Owner agrees that Norfolkcottageholiday.com can process such personal data on its behalf, for the purposes of processing and administering your Booking.

15.2 You agree that Norfolkcottageholiday.com may process your personal data and may need to pass your personal data on to third parties and organisations who need to know them so that the Booking can be provided.

15.3 You agree that Norfolkcottageholiday.com may also process and store your personal details for its own administration purposes.

15.4 You have the right under the Data Protection Act 1998 to obtain information we hold about You. All your personal information is held by Norfolkcottageholiday.com on your behalf. Should you have any queries regarding this right or your personal information please contact Norfolkcottageholiday.com.

LEGAL

16.1 If any provision of the Contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal, or unenforceable, the validity and enforceability of the other provisions of the Contract shall not be affected.

16.2 The Contract shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

DEFINITIONS used in our Booking terms and conditions:

Booking” means a Booking for a Property.

Provisional Booking” means a Booking for a Property that is yet to be confirmed by the Owner or Norfolkcottageholiday.com

Booking Conditions” means these terms and conditions.

Booking Form” means the Booking form on the Norfolkcottageholiday.com website.

Contract” means the contract between You and the Owner for the Selected Property as may be amended from time to time in writing between You and Norfolkcottageholiday.com Ltd. or the Owner.

Owner” means the owner of the Selected Property and “we” and “our” relate to the Owner.

Property” means any of the properties advertised on the Website.

Rental Fee” means the total fee for the Selected Property as set out on the Website or as otherwise agreed in writing including rental, heating, electricity, use of bed linen and towels and VAT if applicable, but excluding any charges for additional services provided by Norfolkcottageholiday.com Ltd. or the Owner.

Rental Period” means the period of time for which You wish to rent the Selected Property for as stated in the Booking Form or other written confirmation of the Booking from You.

Norfolkcottageholiday.com Ltd.” Refers to a company registered in England and Wales with company number 11059009 whose registered office is at 43 Bull Street, Holt, NR256HP.

Selected Property” means the Property specified by You in a Booking.

Website” means the website of Norfolkcottageholiday.com Ltd.

You” means the person who makes a Booking.
